The breeder (1.1) declares that afore-mentioned dog (2.2) was declared healthy by veterinary surgeon Frank on (DATE). The dog (2.2) was dewormed, had the puppy vaccination and has a chip. The veterinary surgeon has examined the dog (2.2) and could not find any infirmities.
If a veterinary surgeon determines distemper and/or Parvovirosis within 10 days after buying (2.1) the dog (2.2), the buyer (1.2) has the right of replacement of the dog (2.2), with another dog of the same value or to claim restitution of the purchase price, namely 700 Euro. |
| (3.2) The way in which diseases or infirmities as meant in (3.1) have to be proven.(3.2) |
In case of a disease or infirmity :
Buyer (1.2) has to notify the breeder (1.1) immediately and ask for advice. The buyer (1.2) has to summon a veterinary surgeon when medical symptoms are visible. Buyer (1.2) has to ask the veterinary surgeon for a statement that the disease is recent and that it’s out of the question that the disease is caused by negligence of the breeder. The breeder (1.1) needs to be informed with a signed statement. The buyer (1.2) will inform the breeder (1.1.) when infirmities are determined within 10 days.
In case of death:
Buyer (1.2) or the veterinary surgeon in attendance informs the breeder (1.1) in writing with the decisive answer. When it's not certain from which disease the dog (2.2) died, the veterinary surgeon of the breeder (1.1) is entitled to ask for an autopsy report from an authorised laboratory at the buyers (1.2) expense. When the results show that the dog (2.2) died from one of the diseases mentioned in (3.1) within the legal period of 10 days after the sale, the laboratory examination is at the breeders (1.1) expense. |
| (4.1) Additional conditions. |
The breeder (1.1) obliges the buyer (1.2) to have X-rays taken of the dog (2.2) within the 16th and 17th week to determine Hipdysplasia through the Pennhip method.The buyer (1.2) is informed about this additional condition before the purchase (2.1) and agreed to the afore mentioned examination (Pennhip).
The breeder (1.1) is obliged to return half the costs of the Pennhip examination, with a maximum of 100 Euro, when breeder (1.1) receives a copy of the Pennhip results from buyer (1.2).
If, due to circumstances, the dog (2.2) can not stay with the current owner, the buyer (1.2) is obliged to return the dog (2.2) to the breeder. |
| (4.2) Pennhip results |
| If the results of the afore mentioned Pennhip examination, show that the dog (2.2) has a serious hip defect of a DI of 0,7 or higher, the buyer (1.2) has the right to select a pup from a following litter or instead of this, get a restitution of the purchase price. The point in time where the dog (2.2), if necessary, is euthanised will be decided by the buyer (1.2) in consultation with the veterinary surgeon, but under the condition that the dog does not suffer from pain. |
| (4.3) Exclusion |
| The buyer (1.2) who discovers that the dog (2.2) at later age, suffers from hipdysplasia, while the results of the examination (4.1) where positive, will receive no consideration for the condition mentioned in (4.2). |
| (5.1) Dissolution of the agreement. |
| When there is a reasonable suspicion or observation of negligence or abuse of the dog (2.2), this agreement will be unilateral dissolved by the breeder (1.1). |
